Requirements for video surveillance:
The use of video systems to monitor public areas and within companies is not permitted without further ado. The applicable legal regulations arise from the EU General Data Protection Regulation (GDPR). However, there are no paragraphs in the GDPR that explicitly deal with video surveillance. Instead, an assessment must be made based on the general clause in Article 6 Paragraph 1 Sentence 1 Letter f of the GDPR.
Accordingly, the collection, processing or storage of personal data is only permitted if it is necessary to protect the legitimate interests of the person monitoring the data or of third parties and does not outweigh the interests or fundamental rights of the data subjects. Consequently, both the interests of the company and those affected (e.g. customers and employees) as well as their fundamental rights must be determined and weighed against each other.
It can be viewed as a legitimate interest if a dangerous situation exists and this can be proven. The industry and business environment can have a significant influence on this, for example if a shop in which valuables are sold is to be monitored. There may also be a legitimate interest if recordings are intended to preserve evidence.
The video surveillance procedure must be included in the list of processing activities (Article 30 GDPR).
